Malaysia online casino law: the Common Gaming Houses Act 1953

Malaysia regulates gambling through the Common Gaming Houses Act 1953, cited as Act 289.

The Common Gaming Houses Act 1953 has been in force since 1953. The Act targets common gaming houses, which are places or arrangements used for unlicensed gaming. It predates the internet, so it contains no separate licensing route for online casinos.

Online casino play in Malaysia is Prohibited. No online operator can obtain a Malaysian licence, so every site that accepts Malaysian players runs under a foreign licence. A foreign licence governs the operator in its home jurisdiction. It does not override Malaysian law for a player who is in Malaysia. Malaysia also has a separate law for lotteries, the Lotteries Act 1952 (Act 288). That law does not make online casinos lawful. This page covers casino play only.

Penalties under Malaysia's gaming law

The Common Gaming Houses Act 1953 penalises players, operators and advertisers separately.

• Players face a fine and a prison term for gaming in a common gaming house.
• Operators face a larger fine and a mandatory prison term for keeping a common gaming house.
• Advertisers face a fine and a prison term for publishing or inviting people to a gaming house.

The split matters for readers. A player is not the main target of the Act, but a player is not exempt from it. Banks and payment providers can also act on their own rules, so a deposit to an offshore casino can fail even when no court is involved.

How offshore casinos treat Malaysian players

Offshore casinos decide for themselves whether to accept players from Malaysia. Some list Malaysia as a blocked country in their terms. Others accept ringgit and local payment methods such as DuitNow, FPX and Touch 'n Go.

We show only casinos that do not block Malaysia in their terms. The terms are the check that matters, because a Malaysian payment option on a cashier page is a sales choice and not a permission. Identity checks add a second filter, since the reasons new casinos ask for ID include confirming where a player lives.

A casino that accepts you today can change its country list later. Withdrawals are the usual point where a restriction appears. Reading the terms before a deposit is cheaper than discovering a block at cash-out.
